Is your building compliant NSW?

On the 15 August 2018 the Commissioner for Fair Trading NSW imposed a building product ban on non-compliant aluminium composite panels (ACP)  in accordance with s.9(1) of  the Building Products (Safety) Act 2017 (NSW).

As of the 22 October 2018 new laws (Environmental Planning and Assessment Amendment Regulation 2018) will come into effect for buildings that contain combustible ACP.  Under the regulations, owners of certain buildings with external combustible ACP are required to register their building with the NSW Government. The deadline to register your building will be the 22 February 2019.

Which buildings are impacted by the ban?

 

Building Type Description
Type A Buildings Class 2, 3 and 9 with three or more storeys and Class 5-8 with four or more storeys;
Type B Buildings Class 2, 3 and 9 with two or more storeys and Class 5-8 with three or more storeys.

Which buildings are impacted by change in regulations?

 

Building Type Description
Class 2, 3 and 9  of two or more storeys Residential Apartments, Hotels, Hostels, Student Accommodation, Aged Care buildings, Hospitals and public assembly buildings e.g. theatres, cinemas, schools and churches.
